1. LEGAL NOTICE AND ACCEPTANCE

This document regulates the use of the Internet Website you have just accessed and which is owned by Rovex Consultants, S.L.U. The use of the Website attributes the condition of User and implies his full and unreserved acceptance of each and every one of the provisions included both in this Legal Notice, and in the General or Specific Conditions of Use, in force at any time the User accesses the Website, so if the User does not agree with any of the conditions established here, he should not use/access this Website.

The Webmaster reserves the right to modify these General Conditions of Use of the website at any time, as well as any other General or Specific Conditions, Rules of Use, Instructions or notices that may be applicable. Likewise, the Webmaster reserves the right to suspend, interrupt or cease to operate the website at any time. Consequently, the user must read this document in its entirety carefully and thoroughly on all those occasions on which the use of the website is proposed, as it may undergo modifications.

All those natural or legal persons resident or domiciled in other countries of the European Union or outside the European Union must ensure that access to and use of the website and/or its content is permitted in accordance with their own legislation. In any case, access to and use of the website by a User who does not comply with the requirement of residence in Spain shall be understood to be under his or her exclusive responsibility, exonerating the Webmaster from any liability to the extent permitted by applicable legislation.

2. PURPOSE

Through the Website, the Webmaster provides Users with access to various contents, services, information and data (the "Contents") made available to Users by third party service and content providers. The Webmaster reserves the right to modify at any time the presentation, configuration and location of the Website, as well as the Contents and the conditions required to use them. In general, the provision of the Services does not require Users to subscribe or register in advance.

3. CONDITIONS OF ACCESS AND USE OF THE PORTAL

3.1. Access and use of the Portal.

The User acknowledges and accepts that access to and use of the website and/or the Contents included therein takes place freely and consciously, under his/her exclusive responsibility. Access to the website and/or the Contents included therein does not imply any kind of guarantee regarding the suitability of the Portal and/or the Contents included therein for particular or specific purposes of the Users. Similarly, it shall be the responsibility of the User to keep all information provided to the Webmaster permanently updated so that it corresponds, at all times, to the User's real situation. In any event, the User shall be solely responsible for any false or inaccurate statements made and for any damages caused to the Webmaster or third parties as a result of the information provided.

In order to use the Services, minors must first obtain permission from their parents, guardians or legal representatives, who will be held responsible for all acts performed by the minors in their care. The User undertakes to make appropriate and lawful use of the Website and its Contents, in accordance with applicable legislation, these General Conditions of Use of the Website, generally accepted morality and good customs and public order. The User must abstain from:

Making unauthorised or fraudulent use of the Website and/or the Contents for purposes or with effects that are illicit, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or which in any way may damage, render useless, overload, deteriorate or prevent the normal use of the Services, the computer equipment or the documents, files and all kinds of content stored on any computer equipment.

  2. Access or try to access resources or restricted areas of the website, without fulfilling the conditions required for such access;

  3. Cause damage to the physical or logical systems of the Webmaster, its suppliers or third parties;

  4. Introduce or spread computer viruses or any other physical or logical systems that may cause damage to the physical or logical systems of the Webmaster, its suppliers or third parties,

  5. Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Contents, unless you have the authorisation of the holder of the corresponding rights or it is legally permitted;

  7. In particular, and for merely indicative and non-exhaustive purposes, the User undertakes not to transmit, disseminate or make available to third parties information, data, contents, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:

 

  1. In any way that is contrary to, disregards or infringes upon fundamental rights and public freedoms recognised by the Constitution, international treaties and other legislation;

  2. Induces, incites or promotes criminal, denigrating, defamatory, infamous or violent actions or, in general, actions that are contrary to the law, generally accepted morals and good customs or public order;

  3. Induces, incites or promotes discriminatory actions, attitudes or thoughts on the grounds of sex, race, religion, beliefs, age or condition;

  4. Incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, generally accepted morals and good customs or public order;

  5. Induce or may induce an unacceptable state of anxiety or fear;

Induce or incite to get involved in dangerous, risky or harmful practices for health and psychic balance;

3.3. Introduction of Links.

Those Users who wish to establish a hyperlink or link between their website and the Webmaster's website (the "Link") must obtain prior authorisation from the Webmaster, by submitting a request to the above-mentioned e-mail address, and are subject to compliance with the following obligations:

  1. The Link will only allow access to the Website, but may not reproduce it in any form;

  2. No links shall be established to pages other than the home page ("homepage") of the Website;

  3. A frame or border environment shall not be created on the Portal;

  4. It shall not be stated or implied that the Webmaster has supervised or assumed in any way the content or services offered or announced on the Website to which the link is established;

The establishment of the link does not in any way imply the existence of any relationship between the Webmaster and the owner and/or operator of the Website in which it is established, nor does it imply knowledge, acceptance and/or approval by the Webmaster of its contents and/or services. 4. RESTRICTED ACCESS AREA

To access and use the restricted access area, Users must first register by filling in a form (the "Registration Form") that appears in each case on the Portal. The Webmaster reserves the right to freely accept or reject the registration request of any User. The data entered by Users on the Registration Form must be accurate, current and truthful at all times, and will be processed by the Webmaster in the manner indicated in the privacy policy.

Registered Users shall be responsible at all times for the safekeeping of their password, and shall consequently assume any damages that may arise from its improper use, as well as from the transfer, disclosure or loss thereof. To this end, access to restricted areas and/or the use of the Contents made under the password of a Registered User shall be deemed to have been made by said Registered User, who shall be responsible in all cases for said access and use. Registered Users may at any time modify their exclusive password as indicated on the Website.

5. INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS

The User acknowledges and accepts that all industrial and intellectual property rights over the Contents and/or any other elements inserted in the website (including, without limitation, brands, logos, commercial names, texts, images, graphics, designs, sounds, databases, software, flow charts, presentation, "look-and-feel", audio and video), belong to the Webmaster and/or third parties. Under no circumstances does access to the Website imply any kind of waiver, transmission, licence or total or partial assignment of such rights, unless expressly established to the contrary. These General Conditions of Use of the Website do not grant Users any other right to use, alter, exploit, reproduce, distribute or publicly communicate the Website and/or its Contents other than those expressly provided for herein. Any other use or exploitation of any rights shall be subject to the prior and express authorisation specifically granted for this purpose by the Webmaster or the third party owner of the affected rights.

The Webmaster authorises Users to use, view, print, download and store the Contents and/or elements inserted in the Website exclusively for their personal, private and non-profit use; provided that in all cases the origin and/or author thereof is indicated and that, where applicable, the copyright symbol and/or industrial property notes of the owners appear. 6. PERSONAL DATA PROTECTION POLICY

In accordance with the provisions of Law 15/1999 of 13 December on the Protection of Personal Data (LOPD), we inform you that the personal information you provide through our website or by sending emails, will be incorporated into an automated file owned by Rovex Consultants, S.L.U., established in Murga Street, Nº 12, 1º Left, 35003, Las Palmas de Gran Canaria, in order to manage, provide, extend and improve the services offered on the website, execute the contracts made through it, send out survey forms, study the use of the services, send out service updates, as well as to send you advertising and/or promotional information on the products and services offered by Rovex or by third parties related to the purchase and sale of consumer goods that may be of interest to you, expressly consenting to the sending of such information by any means, including electronic, among others, email.

The Partner's consent to receive, by email or equivalent electronic means, may be revoked by notification to the following email address: direccion@rovex.es or by regular mail to Rovex Consultants, S.L.U., at the address above. Due to the nature of the service and contents of the website, it is essential to be able to send commercial communications by email to registered users. Therefore, in the event of the revocation of the consent provided for in the previous paragraph, this will automatically lead to the cessation and abandonment of the receipt of communications.

Likewise, the registrant has the possibility of accessing the data collected, and carrying out the appropriate modifications in relation to them. In this regard, the registrant agrees to provide accurate information regarding his or her personal data, and to keep the data provided to Ironika up to date.

The registrant may exercise his/her rights of access, rectification, cancellation and opposition by sending a communication to the address mentioned in the first paragraph of this section, or to the e-mail address: direccion@rovex.es.

The registrant will be responsible, in any case, for the veracity of the data provided, and Rovex reserves the right to exclude from the registered services any registry that has provided false data, without prejudice to other actions that may be appropriate in law.

Minors. Our services are aimed at people of legal age. In the event that some of our services are specifically aimed at minors, Rovex will request the consent of parents or guardians for the collection of personal data or, where appropriate, for the automated processing of data as set out in current legislation.

If the petitioner is a minor, it is required to have the prior consent of his/her parents or guardians before proceeding to include his/her personal data in the forms of the Website.

7. MONITORING TECHNOLOGIES

7.1 Use of "cookie" technology.

The User acknowledges and accepts that the Webmaster may use cookies when a User browses the Website. The Webmaster's cookies are only associated with an anonymous User and his/her computer and do not provide references that allow the User's personal data to be deduced. 8. EXCLUSION OF GUARANTEES AND RESPONSIBILITY

8.1 Exclusion of guarantees and responsibility for the operation of the Portal.

The Webmaster does not guarantee the availability and continuity of the operation of the Website or those other websites with which a link has been established. Likewise, the Webmaster shall in no case be liable for any damages that may arise from:

  1. The lack of availability or accessibility to the Website or to those other websites with which a link has been established;

  2. The interruption in the operation of the Website or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in the telephone lines, the Internet system or other electronic systems produced in the course of its operation;

  3. Other damage that may be caused by third parties through unauthorised interference beyond the control of the Webmaster.

 

Consequently, the Webmaster shall under no circumstances be liable for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations to Users' physical or logical systems, electronic documents or files.

The Webmaster shall in no case be liable for any damages that may arise from:

  2. The inadequacy for any purpose and the disappointment of the expectations generated by the Contents;

  3. Decisions or actions taken or avoided by the User relying on the information or data provided or supplied in the Contents, including without limitation the loss of profits or business opportunities.

 

8.4 Exclusion of guarantees and responsibility in relation to the Links.

The Website makes available to Users technical link devices, directories and search tools that allow Users to access pages and/or websites belonging to and/or managed by third parties. The Webmaster does not check the content of these pages at the time the link is established and does so in the good faith belief that such content complies with applicable legislation. However, under no circumstances does the Webmaster accept responsibility for, approve or make his own the products, services, content, information, data, files and any kind of material existing on such websites and does not control or accept responsibility for, approve or make his own any subsequent modifications to such material.

In the event that the Webmaster deems it appropriate or is required to do so by court or administrative order, the Webmaster will remove the links to those web pages that infringe applicable legislation and/or injure the rights of third parties.

9. PROHIBITION OF UNSOLICITED COMMERCIAL COMMUNICATIONS BY E-MAIL OR ELECTRONIC MEDIA: ANTI-SPAMMING

The Provider of the Service or contents is obliged not to:

  1. Collect data from users for advertising purposes and to send advertising of any kind and communications for sales purposes or others of a commercial nature without their prior request or consent;

  2. Send any other messages not previously requested or consented to to a plurality of people;

  3. Sending chains of unsolicited or previously consented electronic messages;

  4. Use distribution lists that can be accessed through the Services;

  5. Making data collected from distribution lists available to third parties for any purpose.

 

10. ACTIONS IN THE EVENT OF NON-COMPLIANCE

The Webmaster reserves the right to take any and all actions available at law to claim for the liabilities arising from the breach of any of the provisions of these General Conditions of Use of the Website by a User.

The Webmaster may at any time and without prior notice withdraw or suspend the provision of the Services to those Users who fail to comply with the provisions of this Legal Notice and Conditions of Use.

11. PARTIAL NULLITY

The declaration of any of these general conditions as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining conditions, which shall remain binding between the parties. The waiver by either party to demand at any given time the fulfilment of any one of the general conditions stipulated herein shall not imply a general waiver of the fulfilment of another condition or conditions, nor shall it create an acquired right for the other party.

12. APPLICABLE LAW AND JURISDICTION

The provision of the Website service and these General Conditions of Use of the Website are governed by Spanish Law and in particular by Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, and other concordant regulations. To the extent permitted by law, the parties, expressly waiving any other jurisdiction that may correspond to them, agree to submit to the jurisdiction of the Courts and Tribunals of the city of Las Palmas de Gran Canaria.
